What Legal Options Does the Family of a Worker Killed in a Trench Collapse Have in Dallas, TX?

When a construction worker is killed in a trench collapse in Dallas, surviving family members may have legal options that extend beyond a standard workers' compensation claim, and identifying those options early is one of the most important steps a grieving family can take.

In Texas, workers' compensation generally provides death benefits to eligible family members, covering a portion of lost income and funeral expenses. However, trench collapses are subject to strict federal safety regulations under OSHA, and when a third party, such as a general contractor, a subcontractor responsible for trench safety, or an equipment supplier, fails to meet those standards, a separate civil wrongful death claim may also be available alongside workers' compensation benefits.

Trench collapse incidents are among the most heavily regulated workplace hazards in the construction industry, and OSHA maintains detailed requirements for trench shoring, sloping, and protective systems designed specifically to prevent the type of collapse described in this incident.

When a trench collapse occurs during construction, questions about whether proper protective measures were in place, whether the trench was properly inspected, and whether safety protocols were followed can be central to determining liability beyond the employer alone. Evidence such as safety inspection records, project specifications, and OSHA compliance documentation can be critical to establishing what went wrong, and some of this evidence may be difficult to obtain without legal intervention.

The financial losses that surviving family members may be able to pursue in a Texas wrongful death claim can be significant, including the loss of the deceased worker's future income and earning capacity, funeral and burial costs, and the lasting loss of companionship and support.

Because multiple parties may be involved in a large construction project, including general contractors, subcontractors, and equipment manufacturers, identifying all potentially liable parties requires a thorough investigation.

In addition to navigating the relationship between workers' compensation and a potential civil claim, an attorney may be able to help the family preserve important evidence and make sure that any settlement reached accurately represents the extent of their loss.
