How Long Do Families Have to File a Wrongful Death Lawsuit in Texas?

Texas families generally have two years from the date of death to file a wrongful death lawsuit. Missing this deadline can bar the case from moving forward in court. Courts strictly enforce this period and do not allow late filings.

The deadline typically begins on the date of death. In limited situations, it may start later if the cause of death was not immediately known. Courts determine timing based on when medical findings established the loss.

Certain circumstances can extend the filing window. Cases involving minors or legal incapacity may pause the deadline temporarily. Some claims allow additional time when key facts emerge later through evidence.

Texas law designates specific family members who may file a wrongful death claim. This typically includes spouses, children, or parents of the deceased. In some cases, an estate representative may file on their behalf.

Families may pursue compensation for financial and personal losses following a fatal incident. This can include lost income, funeral expenses, and loss of companionship. Each case depends on the facts and documentation involved.
