What Are Your Legal Options After Losing a Loved One in a Dallas DUI Crash?

Ths loss of a loved one in a Dallas DUI crash is devastating, and understanding your legal options can help you pursue accountability and financial stability.

Under Texas law, families may file a wrongful death claim when a fatal accident is caused by another party’s negligence, including drunk or impaired driving.

This type of civil lawsuit is separate from any criminal DUI case and is designed to recover compensation for surviving family members.

In Texas, the right to file a wrongful death lawsuit is limited to the surviving spouse, children, or parents of the deceased. If these parties do not take action within a specified period, the estate’s representative may file the claim.

These claims require proving that the intoxicated driver owed a duty of care, breached that duty, and directly caused the fatal crash.

Compensation in a Texas wrongful death case may include economic damages such as medical bills, funeral expenses, and loss of income, as well as non-economic damages like mental anguish and loss of companionship. In DUI-related fatalities, courts may also award punitive damages to punish especially reckless behavior and deter similar conduct.

Additionally, Texas Dram Shop laws may allow families to hold bars, restaurants, or other establishments liable if they served alcohol to a visibly intoxicated person who later caused the crash.

It is important to act promptly, as Texas enforces a two-year statute of limitations for wrongful death claims.
