Intoxication and Liability Laws in Texas

In Texas, when a driver’s impairment leads to a fatal accident, the legal consequences involve both criminal prosecution and civil liability.

Intoxication Manslaughter is a second-degree felony that occurs when a person operates a motor vehicle in a public place while intoxicated and, by reason of that intoxication, causes the death of another by accident or mistake.

While the criminal case focuses on punishment and state justice, a civil case focuses on providing restitution to the victim's family.

From a civil perspective, Texas is a fault-based state. The family of a deceased victim has the right to file a wrongful death claim against an intoxicated driver, if the latter caused the crash.

When a driver brakes a safety law (driving while intoxicated), they may be automatically considered negligent in the civil case, simplifying the process of establishing liability.

Finally, the statute of limitations for filing a wrongful death or personal injury claim in Texas is two years from the date of the incident.

In cases involving intoxication, it is important to secure evidence early, such as toxicology reports, police body camera footage, and receipts from establishments the driver visited, to ensure all responsible parties are held accountable.

The aftermath of a fatal accident involving an intoxicated driver is incredibly complex. An attorney can help preserve critical evidence, such as the driver's blood alcohol content (BAC) results and cell phone records, and identify all potential sources of insurance coverage.

By handling the legal burdens, a lawyer allows the family to focus on grieving while ensuring that justice is sought for their loved one.
